Forget movies, books or music, my favorite thing to do is to get riled up and complain about annoying people! Oh yes, I probably won't be able to remember the last movie I saw or be able to discuss music with you (because I usually just listen to the radio while I'm on the road and the station with the least yakkity-yak DJs get my loyalty) BUT ask me about the people who annoy me and I can go on and on (which is technically not a good thing).
I don't know why I'm like that though, maybe I like complaining about those people because I'm on this high horse and I like the feeling of
misplaced moral superiority. I'm better than all of you bozos!!! hahahaha!!
Anyway, I went to the Makati Hall of Justice today and the opposing counsel seriously riled me up. At first he was all politiko trying to butter me up with flattering statements but there was just something so fake about him, he was as sincere as James Yap when he denied any dalliance with Hope (evil!). Anyway, after a protracted marking of documents (Because he was obviously unprepared, probably expecting another resetting, he had almost all of the documents from the preliminary investigation marked. That's Annex A to T) the good attorney then asked about the legal basis for my appearance there after all, I was merely a law intern. He insisted that he wasn't questioning my right to be there, instead, he just wanted to know about the legal basis because he was already old and was no longer up to date with the law.
The clerk of court brought out the Rules and I opened it to Rule 138-A. But the good lawyer wasn't satisfied with that because he argued that I didn't have a supervising lawyer with me. I explained that the SL was needed in hearings before the RTC and not before lower courts or administrative bodies. He insisted that the Rules did not make any distinction about the presence of an SL so the SL must be present at all times. At this point, the Clerk of Court spoke up and said that if the good lawyer was contesting my appearance then he should write it in a motion to be decided upon by the Judge. Mr. Legal Eagle then started coughing (for the first time that day) and said that he was sickly and that he might not have the strength to pen a motion, instead, I should just answer his questions right then and there. Finally, the Clerk of Court said that Rule 138-A had a supplement and that he had a copy in his office. The Clerk then said that the questions had been duly noted and would be answered in open court.
After the hearing ended, the smarmy smile returned and he's like: "I hope there are no hard feelings kompanyera. I was really just curious about the law" to which I responded: "Oh none at all sir. I'll bring all the applicable laws in our next hearing, just for your enjoyment".
Once he left the room, the Clerk of Court told me that he didn't want to bring out the supplement to Rule 138-A because he wanted the Judge himself to lecture the attorney on the Student Practice rule. Apparently the Judge was also a UP graduate and probably went through the OLA too. The Clerk then warned me about "matatandang" lawyers, he said that the lower the roll number, the higher the probability was that the counsel would be difficult to deal with.
Which is true. All of the counsels I've gone against this year have been accommodating and even helpful, I've never experienced this sort of open antagonism and intimidation before. Of course, this is the first time that I went against a counsel who was past 50 years old, so that's probably it.
Anyway, I guess he had to show his worth to his clients, hence, the grandstanding and the legal acrobatics. You know what they say about near empty cans and the tremendous racket they inevitably make.
